By accessing or using the Platform, you agree to be bound by these Terms. If you disagree with any of the provisions set forth here, please refrain from using the Platform.
1.1. ConsentPlace offers a marketplace where users can define their interests and preferences for their consent to be used by brands or their advertising agencies ("Advertisers", "Consent Lessees") in a mutually beneficial manner.
1.2. Users ("Consent Owners") can set a price for their consent, and Consent Lessees can browse, select, and rent the consent of Consent Owners for a period of 60 days.
1.3. ConsentPlace acts as an intermediary, facilitating the transaction between Consent Owners and Consent Lessees, and charges a fee for its services. 1.4. The Platform may also provide new, modified, or additional features or services, which may be subject to separate terms.
2.1. Eligibility: You must be at least 18 years old and capable of forming a binding contract to use the Platform. By using the Platform, you represent and warrant that you meet these eligibility criteria.
2.2. Account Registration: You may need to create an account to access certain features of the Platform. You agree to provide accurate and complete information during registration and to keep your account credentials secure.
2.3. Consent Settings: As a Consent Owner, you are responsible for accurately setting and updating your interests and preferences for your consent on the Platform.
2.4. Pricing and Transactions: Consent Owners must set a reasonable price for their consent. ConsentPlace reserves the right to review and moderate prices to ensure fairness and compliance with applicable laws and regulations. All transactions made via the Platform are subject to ConsentPlace's fees, as indicated in Section 3.
2.5. Compliance with Laws: You agree to comply with all applicable laws, regulations, and guidelines when using the Platform. You are solely responsible for ensuring that your use of the Platform, including the provision of your consent, does not violate the rights of third parties.
3.1. ConsentPlace charges a fee to facilitate transactions between Consent Owners and Consent Lessees. The fee structure may be specified separately on the Platform or through other communication channels.
3.2. ConsentPlace reserves the right to modify the fee structure at its sole discretion, providing reasonable notice to users.
4.1. ConsentPlace respects your privacy and processes personal information in accordance with its Privacy Policy. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.
5.1. Ownership: Consent Owners retain all rights and ownership over their consent. Consent Lessees must not claim ownership or rights over the consent purchased via the Platform.
5.2. Platform Content: All text, graphics, images, video, software, and other content provided on the Platform are the property of ConsentPlace or its licensors and are protected by intellectual property laws. You may not use, modify, or distribute any content from the Platform without obtaining explicit permission from ConsentPlace.
6.1. By using ConsentPlace (the "Platform"), you expressly consent to receive all types of communication, including but not limited to emails, notifications, messages, and updates, from ConsentPlace, its affiliates, partners, and authorized agents. This communication may include, but is not limited to, information about your account, updates, promotional offers, news, and other relevant content related to the Platform.
6.2. You acknowledge that this communication is an integral part of your use of the Platform and agree that it may be sent electronically to the email address or contact details you provide during the registration or account creation process. You also understand that you may receive communications even if you have opted out of other types of notifications.
6.3. Please note that by using the Platform, you agree to receive Platform-related communications, and you cannot opt out of essential service communications, such as security updates or changes to our Terms of Use.
7.1. The Platform is provided "as is" and "as available". ConsentPlace makes no representations or warranties, express or implied, regarding the accuracy, reliability, or completeness of the Platform or the consent provided by Consent Owners.
7.2. ConsentPlace does not endorse any Consent Lessees and does not guarantee the quality, suitability, or safety of their products or services.
8.1. To the extent permitted by applicable law, ConsentPlace shall not be liable to you or any third party for any direct, indirect, incidental, consequential, or special damages arising from or in connection with your use of the Platform or any content available on it.
9.1. Entire Agreement: These Terms constitute the entire agreement between you and ConsentPlace regarding your use of the Platform and supersede all prior or contemporaneous agreements, written or oral.
9.2. Governing Law and Jurisdiction: These Terms are governed and interpreted in accordance with the laws of the country where ConsentPlace is located. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
By accepting these Terms, you acknowledge that you have read, understood, and accepted the terms and conditions set forth herein. If you do not accept these Terms, please do not use the ConsentPlace platform.
